genetic tests from the collection of deoxyribonucleic acid (“DNA”) samples and interpretation
that evaluates your genetic profile and produces reports on nutrition, fitness, and well-being.
EPIGENE reports provide information that enables you to make more informed decisions
about your health and well-being. Before submitting your sample to EPIGENE, you expressly
declare that you agree and consent to the following:
- I am over 18 (eighteen) years old, have full civil capacity, and will provide a sample of my
DNA or the DNA of a person for whom I am a parent or legal guardian or a person from
whom I have obtained formal authorization for the submission of their DNA sample to
EPIGENE. - EPIGENE will perform DNA analysis from a sample (a cheek swab) provided specifically
for the genetic test. In some cases, an additional sample may be required if the volume or
quality of the sample is not adequate. - I understand that, due to the limitations of technology and incomplete knowledge of gene
action, some alterations may not be detected and that there is a possibility that I may carry a
genetic alteration, even with a negative result. The accuracy of DNA tests for genetic
diseases depends on accurate data from personal and family history. A positive result
indicates a predisposition or presence of a specific disease, and further studies may be
necessary to confirm these findings. - EPIGENE will securely store my DNA sample indefinitely. I can formally request that my
sample be destroyed at any time. - EPIGENE will interpret the data and information obtained from my sample and provide a
personalized report only for the DNA test(s) requested by me and/or by the health
professional authorized by me. - EPIGENE may communicate with me about new genetic discoveries and offer me the
opportunity to conduct additional tests and analyses, subject to my express agreement. I
may cancel the receipt of further genetic information at any time by sending a request to the
email contato@epigene.com.br. - My reports and genetic data will be treated as my property and will never be disclosed or
shared with third parties, except when expressly authorized by me. - EPIGENE may analyze my results in an anonymized manner for evaluation, research, and
marketing purposes. - EPIGENE will make my results available to me in a secure and confidential manner.
- My sample will be analyzed for the genes and regions identified in the selected
service(s) that have a high degree of scientific credibility, reviewed, and approved by the
EPIGENE scientific team. My genetic information, personal data, and results may be stored
and used by EPIGENE for regulatory compliance purposes. No additional analyses and
reports of genes and regions beyond those relevant to the requested Test will occur unless I
explicitly agree to future products or services, including additional tests and analyses of
genes and regions not initially identified in the selected services. - All data and any generated results are kept confidentially in a secure data protection
protocol, in compliance with EPIGENE’s Privacy Policy (available through the link

f). - Results of tests requested by doctors, sports agents, clubs, gyms, and others on behalf
of the patient/client, provided they are expressly authorized in writing, will be shared with the
requester. Any personal or genetic data provided by EPIGENE under these conditions must
be used ethically, transparently, and with the prior and express consent of the patient/client. - EPIGENE does not authorize or endorse the use of genetic data for segregation or
selection based on genetic and biological aspects for professional purposes, regardless of
the patient/client’s area of activity. - The information and results from the DNA samples analyzed by EPIGENE will be kept
confidential in strict compliance with EPIGENE’s Privacy Policy, except in cases where

mobile applications, service channels (including but not limited to WhatsApp), and ancillary
services that may be offered to the User through the Access Platform.
viii. Users: Those who have registered, browse, and use the functionalities of the Access
Platforms.
ix. Visitors: Users who have not subscribed to Exclusive Content, having limited access to
the Access Platforms.
II. GENERAL INFORMATION
This Privacy Policy aims to provide information about the collection, use, storage,
processing, and protection of the personal data of Users or Visitors of EPIGENE ANÁLISE E
EXAMES S.A. (“EPIGENE”) Access Platforms, with the purpose of demonstrating absolute
transparency with the rules of privacy and protection of collected personal data, in
compliance with Law No. 13.709/18 (“General Data Protection Law” or “LGPD”) and Law No.

through an examination performed by EPIGENE or provided by the User.
EPIGENE does not disclose Personally Identifiable Information and Health Data
received from Users or Visitors through service channels to third parties, except when such
data is used by EPIGENE in anonymized format. Such data may only be used for the
evaluation of the new channel or if disclosed by the User or Visitor themselves. The
information collected through the use of the communication channel will be used for the
proper provision of services and to enhance the functionalities available through the channel,
including through the generation of statistical reports.
IV. PURPOSE OF DATA USE
The personal data of Users or Visitors collected and stored by the Access Platforms are

The data produced by EPIGENE’s software is the exclusive property of the User. EPIGENE
is not responsible for the improper use of data and information obtained.
V. DATA STORAGE PERIOD
Mandatory Data and Health Data are stored by the Access Platforms for the period
necessary for the use of the functionalities of the Access Platforms or the fulfillment of the
purposes provided in this document, as stipulated in item I of Article 15 of the LGPD.
Furthermore, Mandatory Data and Financial Data of Users or Visitors can only be retained
after the end of their processing in the cases provided for in Article 16 of the LGPD.
VI. SECURITY OF STORED PERSONAL DATA
The database formed by the collection of data from Users and Visitors is owned and
managed by EPIGENE, and its use, access, and sharing, when necessary, will be carried
out within the limits and purposes of EPIGENE’s business and described in this Privacy

EPIGENE disclaims liability for the exclusive fault of third parties, such as in cases of hacker

organization, (xiii) production of studies and scientific articles for presentation at events,

hospitals, clinics, pharmacies, etc.) when necessary to enable the offering of new well-being
and health products and services to the User.
All contracted third parties are obligated to treat the data confidentially and solely for the
contracted purpose, ensuring legal compliance in matters of privacy and data protection, and

5.3. The User who acquires access to Exclusive Content on the Access Platform,
agree, acknowledge and declare that it is strictly prohibited:

disparagement based on race, color, national origin, sex, sexual orientation,
age, disability, religious or political beliefs, or other legal status
protected, linking the EPIGENE image;
b) falsify and transmit, by any means, any information linking to
image of EPIGENE;
c) use any information received through the Tests or any other
services purchased from EPIGENE to try to identify other customers;
d) upload, post, email or otherwise transmit any
content that infringes any patent, trademark, trade secret,
copyright or other proprietary rights of EPIGENE;
e) upload, post, email or otherwise transmit any
material that contains software viruses or any other computer code
computer, files or programs designed to interrupt, destroy or
limit the functionality of any computer software or hardware or
telecommunications equipment;
f) replace any security component of the Access Platforms;
g) interfere with or disrupt the servers or networks connected to the Platforms
Access, or disobey any requirements, procedures, policies or
regulations for networks connected to Access Platforms;
h) violate these Terms, any code of conduct or other guidelines that may
be applicable to any area of use of the Access Platforms; or
i) violate any applicable local, state, national or international law, or
any regulations having the force of law.
5.4. Any violation of these Terms, including incorporated policies such as
Privacy Policy may give rise to appropriate legal measures for redress.
5.4.1. The User who gives rise to the legal measures mentioned in this clause,
shall compensate for any losses, including losses and damages, costs and

informative and educational, no medical advice is provided.
6.2.1. EPIGENE does not endorse or guarantee the effectiveness of any course of action

medicines, biological products, medical devices or other products,
procedures, opinions or other information that may be mentioned in our
site. Any recommendations and/or possible ways of acting are intended solely for
information and for discussion with your doctor or other healthcare professional. You
tests are not intended to be used by the customer for any
diagnosis and are not a substitute for professional medical advice.
VII. USE OF ARTIFICIAL INTELLIGENCE
7.1. EPIGENE uses Artificial Intelligence (“AI”) to carry out certain
interactions with the User. In this sense, by accepting the terms and conditions now
established, the User expressly agrees that personal data
traffic on Epibot may be processed by AI, for Epibot to function,
remaining responsible for ensuring all necessary authorizations to
this use.
7.2. EPIGENE and the User recognize that AI may have limitations and
inaccuracies, and it is not possible to guarantee the accuracy or completeness of the results
obtained.
7.3. The User is responsible for verifying, in accordance with the Territory provided for in this
Term,
whether the use of Epibot is in any way, directly or indirectly, prohibited in your
locality. If you identify any impediment, you must refrain from using
Epibot or immediately stop using it without attracting any
responsibility for EPIGENE in this regard.
VIII. NO RESPONSIBILITY FOR CONTENT
8.1. The User is responsible for the content sent to Epibot and must ensure that
holds all rights and authorizations necessary for its sending and use by
EPIGENE. You warrant, to the best of your reasonable knowledge, that the content provided
does not violate any legal provision, these Terms or the rights of third parties.
8.2. EPIGENE is not obliged to analyze the content of files sent to Epibot,
not being responsible for its improper, improper or illegal use, nor for any
violation of the rights of third parties, without prejudice to their prerogative to verify the
compliance of your use of Epibot, at the sole discretion of EPIGENE. You will be
responsible for any penalty or sanction eventually applied to EPIGENE
for non-compliance with this Term.
8.3. Without prejudice to the provisions above, EPIGENE, at its sole discretion, protects itself
the right not to transcribe audios that potentially contain offensive content,
inappropriate, discriminatory or illicit, without this generating any type of burden on
EPIGENE.
8.4. The User undertakes not to share sensitive personal data,
as defined in applicable legislation, including health information, origin
ethnic or racial beliefs, religious beliefs or sexual orientation of third parties without
authorization

sensitive or financial information, such as any account identifiers or
passwords.
8.5. The User is aware that Meta may review the content of interactions via
WhatsApp, whether or not by automated means, including, without limitation, to monitor the
use of Epibot in order to ensure compliance with Meta policies and the
applicable legislation, as well as to remove unsafe, discriminatory or
others that violate Meta policies; without any interference from EPIGENE over the
actions taken by Meta.
8.6. Your use of the Access Platforms will be at your own risk. In addition to the
disclaimers provided for in this Term, you agree that the Platforms
of Access are provided as is (“as is”). To the maximum extent permitted by
applicable legislation, the Access Platforms do not provide any guarantee of
any type. EPIGENE does not guarantee that the Access Platforms (i) will be
available without interruptions; (ii) will be error-free; (iii) will offer answers
relevant to your questions; or (iv) will meet your desired objective.
IX. CONDUCTS AND OBLIGATIONS OF EPIGENE
9.1. EPIGENE undertakes to:
a) ensure that Access Platforms have a secure virtual environment,
in order to safeguard the User and the Visitor, except with regard to interaction
of Access Platforms with their native platforms, which is why
the terms and conditions of use and responsibilities must be observed
established on their respective native platforms;
b) develop Genetic Mapping according to the Test acquired by the
User, obeying the best applicable technique, under its exclusive
responsibility and observing the quality standards usually required; It is,

9.2. Eventually, the use of Access Platforms may be interrupted
due to: (a) acts of God or force majeure; (b) actions of third parties that prevent access

suspension of telephone services by the concessionaire; (e) technical maintenance and/or
operations that require temporary shutdown of the system or make it impossible to

interruptions related to the events foreseen in the item above, or those in which no
contributed to causing the damage and/or loss.
9.3. EPIGENE will make its best efforts to ensure and develop the
quality of Access Platforms, also committing to respect the
privacy of the Visitor or User, maintaining confidentiality of all Personal Data
Identifiers provided by him, including password, which will only be disclosed to third parties

reason of judicial request and/or public authority and/or in the personal interest of the
Visitor or User.
9.4. EPIGENE’s responsibility in relation to any recommendations for
service providers performed by the Access Platforms is carried out within the
limits of reasonable knowledge about the information published by professionals
and companies nominated.
9.5. EPIGENE does not offer guarantees nor is it responsible for the reliability,
veracity, usefulness and quality of information disclosed by third parties.
9.6. In the event that it is found, in any of the contents and/or services,
any incorrect or harmful information published by the User, EPIGENE
will carry out the necessary corrective measures.
9.7. In the event that any Exclusive Content is found to contain any
harmful elements to Users’ systems, EPIGENE will immediately carry out the
necessary corrective measures.
X. PRIVACY
10.1. EPIGENE has its own document, called Privacy Policy for
Access Platforms, which regulates the processing of information.
XI. PRICES AND PAYMENT METHOD FOR SERVICES
11.1. As consideration for the acquisition of Exclusive Content and/or Tests, the
User must pay EPIGENE the amount contained in the contractual confirmation, on the dates
and/or frequency referred to therein (“Consideration”).
11.2. The User may choose the payment methods available on the Platforms
of Access at the time of contracting.
11.3. From the moment the Exclusive Content and/or
Tests, the Consideration will be charged in the manner indicated when formalizing the
acquisition.
11.4. The Subscriber will only have access to Exclusive Content and testing
only after proof of payment of the Consideration by the respective
financial institution. Therefore, failure to approve payment due to lack of
credit or any problem attributable to the User or the financial institution will exempt
EPIGENE to release access to Exclusive Content and any other obligations
provided for in these Terms.
11.5. Taxes and other tax charges that are due, directly or indirectly,
by virtue of amounts paid or received under these Terms or by virtue of your
execution will be the responsibility of the taxpayer as defined in the tax rule,
without right to refund.
XII. RIGHT OF REPENTANCE AND TERMINATION HYPOTHESES
12.1. The User has a period of 7 (seven) calendar days, counting from the date of
payment of the Consideration, provided that the Genetic Mapping Test has not
been processed and/or the User has not made use of Epibot during this period, to
exercise your right to regret and cancel your purchase, without paying

12.3. In the event that payment of the Consideration is made through

XIII. GENERAL PROVISIONS
13.1. EPIGENE reserves the right to modify these Terms and the Privacy Policy

13.2. These Terms are irrevocably and irreversibly signed,
obliging the Parties, as well as their heirs and successors, in any capacity.
13.3. Tolerance of possible non-compliance with any of the clauses and

time.

13.5. EPIGENE reserves the right to change, discontinue, cancel or suspend
any of the Contents, made available by you or third parties, as long as you communicate
the User 24 (twenty four) hours in advance, by email or any other
electronic means.
XIV. JURISDICTION FOR DISPUTE RESOLUTION
For the resolution of disputes arising from these Terms, the
fully comply with the legislation in force in the Federative Republic of Brazil.
Any disputes must be presented and discussed in the court of the district in which they
occur.
